Overstaying visa validity should be avoided but in case of unavoidable circumstances, you can inform the authorities and apply for a new visa type or extend your current visa.

What is overstay in USA?

Overstay in USA is when you are still in the country even after your visa has expired. To avoid this, it is essential that you are aware of your visa expiry date. This is to enable you to book international flights prior to the end of your authorized stay.

What happens when you overstay your visa?

  • Overstay in USA despite the expiration of your visa will bar you from returning to the country for 3 to 10 years. This is based on how long you have overstayed.
  • Overstaying visa in the US may also restrict you from extending your stay or change of visa status.
  • Overstaying a US visa can also revoke or cancel your existing visa.
  • Overstaying visa will also not allow you to get a new visa except in your home country.
  • Overstaying a US visa might also not allow you to Adjust Status in the country even though you might be eligible.

Try Applying for an Extension

If you are already aware that you might have to overstay your visa validity, you can apply for an extension or seek to change the status. Although processing of your application might take some time, it will make it clear that you had intended to avoid overstaying your student visa

The American dream is set to get more expensive! After announcing a hike of a whopping 70% for US employment-based visas earlier this year, the United States has announced an increase in the US tourist and student visa application fee as well.

Effective from May 30, the non-immigrant visa application fee will be hiked from the existing $160 to $185. The application fee for the E category will increase to $315 from $205, while the cost of visa application for temporary workers would increase by $15. With thousands of people applying for various US visas, it is to be seen how this will impact tourism in the country.

Apart from tourist and business visas, the US gets a lot of student visa applications every year. And Indians are the major receivers of these visas. In 2022 alone, approximately 1,25,000 students from India were able to fulfill their dream of studying in USA.

Amid this, the US Consulate in Mumbai has started accepting all immigrant visa services but routine non-immigrant visa services are only limited at the Embassy in New Delhi and consulates in Hyderabad, Mumbai, Kolkata and Chennai.

The USA government is also doing its best to reduce wait times for US visas. This has already helped a lot of visa applicants and has been improving the visa acceptance rate significantly.

Latest US-India Travel Updates: Good news for students who have received their I-20 documents from their universities and are waiting for the interview process to begin! The US Embassy in India has announced that appointments for F, M, and J visa interviews are now available for booking for students with an I-20 form.

Interviews for these student visa types will begin after August 14, said the US Embassy in its tweet on the official ‘U.S. Embassy India’ Twitter page. “So if you need to arrive at school by mid-Aug, book an appointment now!” tweeted the Embassy.

This announcement comes a few days after the Ministry of External Affairs (MEA) urged various countries, including the USA, UK, Canada, Australia, Germany, New Zealand, Poland, and the Czech Republic, to expedite the visa process for Indian students.

Earlier in May, the US Embassy opened the first set of interview slots for students for the dates spanning the month of June and the first half of July. This year, the Embassy plans to issue more student visas; surpassing the previous year’s record of issuing 62,000 visas for students who headed to US universities in the autumn of 2021.

Students seeking F, M, and J visas can visit the official website of the US Embassy in India and book an appointment for student visa interviews scheduled past 14 August.
