H-4 EAD Work Permit

The US DHS has listed a proposal that could end employment authorization for certain H-4 visa holders. The move may affect H-1B visa spouses who currently work in the United States with an H-4 EAD work permit. The proposal is still at an early stage. It has not changed the current H-4 EAD rules, and valid EAD holders can continue to work legally in the US. However, the update has raised concerns among H-1B families, especially Indian professionals and their spouses.

What Is the H-4 EAD Proposal?

The Department of Homeland Security (DHS) plans to remove certain H-4 dependent spouses from the category of people eligible to apply for employment authorization. If DHS finalizes the proposal, eligible H-4 spouses may no longer be able to apply for an Employment Authorization Document, also called an EAD. The rule would reverse the 2015 policy that allowed some H-4 visa holders to work in the United States. At present, DHS has included the proposal in its long-term regulatory agenda. It has not announced a date to publish the formal rule.

What Is an H-4 Visa and H-4 EAD?

An H-4 visa allows the spouse and unmarried children under 21 of an H-1B visa holder to live in the United States. However, an H-4 visa alone does not give a spouse the right to work. Eligible spouses must apply for and receive an H-4 EAD before they can take up a job, start a business, or work as an independent professional in the US. The H-4 EAD has helped many families add a second income and allowed spouses to continue their careers while living in America.

Who Can Get an H-4 EAD Under Current Rules?

Not every H-4 visa holder qualifies for an EAD. Under current rules, an H-4 spouse may apply when their H-1B spouse has reached an advanced stage in the employment-based green card process. This usually includes cases where the H-1B worker has:

  • An approved I-140 immigrant petition
  • An H-1B extension beyond the usual six-year limit under green card rules

Eligible applicants must submit Form I-765 to USCIS and receive approval before working.

Will Current H-4 EAD Holders Lose Their Jobs Now?

No. The proposal does not cancel existing H-4 EAD work permits. H-4 spouses with a valid EAD can continue working under the current policy. DHS must complete several steps before any rule can take effect. Until DHS completes the required process, the existing H-4 EAD programme remains in place.

Why Indian H-1B Families May Be Affected Most

The proposed H-4 EAD change may have a major impact on Indian families in the United States. Indian professionals receive a large share of approved H-1B visas, and many H-4 EAD holders are Indian women. For many families, an H-4 EAD supports career growth, financial independence, and household income. If the government ends the programme, affected spouses may need to stop working when their current EAD expires, unless they qualify for another work-authorized visa.

The change could also make it harder for highly skilled H-1B workers to settle in the US with their families.

What H-4 EAD Holders Should Do Now

H-4 EAD holders do not need to leave their jobs because of this proposal. Still, they should take a few practical steps:

  • Check the expiry date on their H-4 EAD
  • File renewal applications on time, if eligible
  • Keep copies of immigration documents and approval notices
  • Follow official USCIS and DHS announcements
  • Speak with a qualified immigration lawyer for advice on their case

The proposal to end H-4 EAD work permits could affect thousands of H-1B visa families in the United States. However, it is not a final rule, and no immediate change applies to valid H-4 EAD holders. For now, eligible spouses can continue working under the current H-4 EAD rules. They should stay informed, renew documents on time, and watch for official immigration updates.

USCIS is changing the editions of Form I-539 and Form I-765 starting September 15, 2026. The most important thing to remember is simple: if you file either form on or after September 15, you must use the new 09/15/26 edition. There is no grace period.

What is changing?

Form I-539 – Application to Extend/Change Nonimmigrant Status

  • Current edition: 08/28/24
  • New edition: 09/15/26
  • Purpose: Used by eligible nonimmigrants to extend or change their status while in the U.S.

Form I-765 – Application for Employment Authorization

  • Current edition: 08/21/25
  • New edition: 09/15/26
  • Purpose: Used to apply for an Employment Authorization Document (EAD), or work permit.

The September 15 rule

Think of September 15 as the cut-off date.

If you file before September 15, 2026:

  • You can use the current editions.
  • I-539 → 08/28/24
  • I-765 → 08/21/25
  • The form must be postmarked or electronically submitted before September 15.

If you file on or after September 15, 2026:

  • You must use the new 09/15/26 edition.
  • USCIS will reject the older edition.
  • There is no grace period.

This means someone filing an I-539 on September 10 can use the 08/28/24 edition. But someone filing it on September 15 or later must use the 09/15/26 edition.

Who should pay attention?

The change applies to people who use these forms, including certain students, exchange visitors, H-4 dependents and other eligible nonimmigrants.

For H-1B families, there is an important distinction:

  • H-1B workers generally use Form I-129, filed by their employer, to extend or change H-1B status.
  • H-4 spouses and children may use Form I-539 to extend or change their H-4 status.
  • Certain eligible H-4 spouses may use Form I-765 to apply for an EAD.
  • H-1B workers generally do not use I-765 for their H-1B work authorization.

The change also relates to a new USCIS final rule concerning fixed periods of admission and extension-of-stay procedures for certain academic students, exchange visitors and representatives of foreign information media.

Don’t use the new forms early

USCIS is providing preview versions of the new 09/15/26 forms and instructions before the change takes effect. However, do not file the 09/15/26 editions before September 15, 2026.

One important clarification: If USCIS rejects a form because you used the wrong edition, that is different from denying your immigration benefit. A rejection means USCIS did not accept the filing because of the form problem. It does not mean USCIS reviewed your case and decided you were ineligible.
