USCIS is changing the editions of Form I-539 and Form I-765 starting September 15, 2026. The most important thing to remember is simple: if you file either form on or after September 15, you must use the new 09/15/26 edition. There is no grace period.

What is changing?

Form I-539 – Application to Extend/Change Nonimmigrant Status

  • Current edition: 08/28/24
  • New edition: 09/15/26
  • Purpose: Used by eligible nonimmigrants to extend or change their status while in the U.S.

Form I-765 – Application for Employment Authorization

  • Current edition: 08/21/25
  • New edition: 09/15/26
  • Purpose: Used to apply for an Employment Authorization Document (EAD), or work permit.

The September 15 rule

Think of September 15 as the cut-off date.

If you file before September 15, 2026:

  • You can use the current editions.
  • I-539 → 08/28/24
  • I-765 → 08/21/25
  • The form must be postmarked or electronically submitted before September 15.

If you file on or after September 15, 2026:

  • You must use the new 09/15/26 edition.
  • USCIS will reject the older edition.
  • There is no grace period.

This means someone filing an I-539 on September 10 can use the 08/28/24 edition. But someone filing it on September 15 or later must use the 09/15/26 edition.

Who should pay attention?

The change applies to people who use these forms, including certain students, exchange visitors, H-4 dependents and other eligible nonimmigrants.

For H-1B families, there is an important distinction:

  • H-1B workers generally use Form I-129, filed by their employer, to extend or change H-1B status.
  • H-4 spouses and children may use Form I-539 to extend or change their H-4 status.
  • Certain eligible H-4 spouses may use Form I-765 to apply for an EAD.
  • H-1B workers generally do not use I-765 for their H-1B work authorization.

The change also relates to a new USCIS final rule concerning fixed periods of admission and extension-of-stay procedures for certain academic students, exchange visitors and representatives of foreign information media.

Don’t use the new forms early

USCIS is providing preview versions of the new 09/15/26 forms and instructions before the change takes effect. However, do not file the 09/15/26 editions before September 15, 2026.

One important clarification: If USCIS rejects a form because you used the wrong edition, that is different from denying your immigration benefit. A rejection means USCIS did not accept the filing because of the form problem. It does not mean USCIS reviewed your case and decided you were ineligible.

The WISA Act, formally known as the Welcoming International Success Act, is a newly introduced US immigration bill WISA designed to reverse restrictive changes to the H-1B visa program, making it simpler for American employers to hire highly skilled foreign workers, including a large number of Indian professionals. Introduced on March 6, 2026, by Congresswoman Bonnie Watson Coleman, the US new WISA proposal directly addresses barriers that have limited access to global talent in critical sectors. The WISA bill US aims to restore flexibility in the hiring of global talent through the H-1B work visas system.

Key Facts About the H-1B Visa Program

The H-1B visa program allows US employers to temporarily hire foreign workers in specialty occupations requiring at least a bachelor’s degree, such as software development, engineering, data science, medicine, and research. It caps at 85,000 visas annually (65,000 general plus 20,000 for advanced degrees), with high demand leading to the H-1B lottery system. Indians have long dominated approvals, securing about 71-72% of visas in recent years due to strengths in IT and STEM fields, supporting over 500,000 Indian nationals and dependents among H-1B visa holders in the US workforce.

New H-1B Restrictions Introduced in 2025

In September 2025, a new presidential order created big obstacles for the H-1B visa program, which U.S. companies use to hire skilled foreign workers through H-1B work visas.

Key changes:

  • Employers must now pay a $100,000 sponsorship fee for each new H-1B worker applicant.
  • Stricter wage rules raised minimum salaries sharply. For example, entry-level IT jobs in expensive areas like San Francisco now start around $200,000.

These steps aimed to reserve visas for top global talent while protecting U.S. workers from lowball pay. Instead, they led to far fewer petitions, massive processing delays, and headaches for schools, hospitals, and tech giants that rely on international H-1B workers.

Key Provisions of the WISA Act

The WISA Act and the broader new US visa bill for H1B seek to fully repeal the 2025 proclamation by prohibiting any federal funds from implementing it. Key actions include:

  • No more $100,000 fee: Employers no longer pay this huge sponsorship cost for new H-1B visas. It eases the money burden on companies.
  • Lower wage minimums: Wages go back to 2025 levels set by the Department of Labor. For jobs like computer programmers, this drops requirements from unbelievable highs to real-world rates ($80,000-$150,000 based on skills and location).
  • Faster, safer approvals: Ends extra strict reviews that slowed everything down and raised rejection chances.
  • Helps nonprofits and schools: Makes hiring smoother for universities, hospitals, and research groups in areas like healthcare, teaching, and engineering.

This US new WISA proposal would restore the program’s efficiency, allowing quicker matching of US job needs with global skills.

Potential Benefits of the WISA Bill for Indian Professionals

For Indian applicants, who make up over 70% of the 730,000+ H-1B visa holders, the WISA bill US brings real relief. It eases sponsorship by cutting out sky-high fees and rigid salary rules. This raises their odds of winning the H-1B lottery and getting approved. Professionals in tech hubs like Silicon Valley or Austin could transition jobs more fluidly. They can maintain careers despite the annual cap. Families benefit from fewer uncertainties in dual-intent status, where H-1B work visas allow green card pursuits alongside work.

Industry and Employer Benefits of the WISA Act

US companies, especially in technology (e.g., Google, Microsoft, Amazon with heavy Indian hires), save millions in fees and compliance, enabling more diverse teams to innovate. Healthcare providers access doctors and nurses, while universities retain researchers amid domestic shortages. The US immigration bill WISA also supports economic growth by filling 1 million+ STEM job gaps projected through 2030, with H-1B workers contributing $200 billion+ annually in taxes and spending.

WISA Act and Its Role in Green Card Stability

While focused on H-1B work visas, the WISA Act indirectly aids green card processes by stabilizing employment status. H-1B visa holders can remain in the US indefinitely during I-140/I-485 waits without fee-induced layoffs. It doesn’t lift per-country EB-2/EB-3 caps (causing 10+ year Indian backlogs) but prevents new restrictions from compounding delays. Employers file fewer risky PERM labor certifications under eased wages. This could potentially speed EB sponsorships.

Broader Impact of the WISA Act on Skilled Immigration

If enacted, the US new WISA proposal reinforces the H-1B visa program as a bridge to permanent residency, sustaining US leadership in AI, biotech, and software.

For Indians, it preserves a vital route: from campus F-1 visas through OPT to H-1B work visas and eventual citizenship, fueling bilateral tech ties worth billions in remittances and investments. The proposal underscores the program’s role in addressing labor shortages, with 80% of H-1B workers in high-growth areas unmatched by US graduates.

Frequently Asked Questions

Can current H-1B holders apply for refunds on 2025 fees?
Unlikely, as WISA targets future enforcement. Paid $100,000 fees under the proclamation would not be retroactively refunded, though employers might see savings on renewals or new hires.

What occupations qualify under restored H-1B rules?
Specialty roles needing a bachelor’s degree or equivalent, like IT analysts, engineers, accountants, physicians, architects, and professors. WISA reverts wage levels to match actual market data, easing approvals for mid-level positions.

Does WISA help with H-1B to L-1 visa switches?
Not directly, but lower costs and faster processing free up employer resources for intracompany L-1 transfers. Indian IT firms often use both for multinational staff.

How soon might USCIS update forms after the WISA passage?
Typically 30–90 days after enactment. Forms I-129 (H-1B petition) would drop the new fee line, and prevailing wage data reverts through Department of Labor updates. Check uscis.gov for alerts.

Is WISA relevant for OPT or F-1 students transitioning to H-1B?
Yes, it improves H-1B lottery-to-approval odds for Indian STEM OPT holders by cutting employer costs, helping more cap-gap extensions during waits.

What if an employer paid the fee before WISA?
Petitions filed pre-passage follow old rules. WISA blocks new implementations, so mid-year filings benefit immediately if the bill halts funding swiftly.

Where to track WISA updates for visa planning?
USCIS.gov, DOL.gov wage site, congress.gov (search by sponsor), and immigration law firm blogs. Indian H-1B communities on Reddit (r/h1b) or forums like Trackitt aggregate real-time changes.
